Neverest guarantees that new products will be free from manufacturing and physical defects during the warranty period set forth below. The billing date for the original purchase is the start date of the warranty period. This warranty applies only to defects discovered during the warranty period and is given only to the first owner of the product. Parts repaired or replaced under the terms of this warranty are warranted for the remainder of the original warranty period only.
To benefit from the warranty, you must contact Neverest or an authorized distributor within 30 days after the date of discovery of any defect, and you must allow access to the product for examination by representatives of Neverest or its service department. Neverest's obligations under this warranty are limited to the following.
Warranty period and conditions
The terms and conditions of this warranty apply to all cardio equipment for commercial gyms.
Warranty period
- Frame — 2 years
- Treadmill drive — 2 years
- Non-wear-resistant parts — 1 year
- Mechanical and electronic components — 1 year
- High-wear parts of the console, including headphone jacks and USB ports — 90 days
- Batteries, non-built-in receivers, non-built-in PVC and controllers — 90 days
- Installation of equipment (including the base, console, and PVC) — 1 year
Terms and conditions
This warranty is valid only under the terms and conditions set forth below:
- The warranty applies to Neverest products only if the following conditions are met.
- The product was serviced exclusively by a Neverest-authorized service provider and/or Neverest-authorized fitness center personnel.
- The product belongs to the original owner, who is able to confirm the fact of purchase.
- The product has not been subjected to improper use, misuse, accidents or modifications.
- Claims are accepted during the warranty period.
- This warranty does not cover damage or malfunction of the equipment caused by not following the electrical wiring practices adopted or specified in the accompanying product documentation or Neverest specifications, or by not following the proper maintenance requirements specified in the accompanying product documentation.
- Neverest cannot guarantee that the heart rate measurement system provided by the company's products will suit all users in all circumstances. The accuracy of heart rate measurements varies depending on a number of factors, including the health and age of the user, the method of using the equipment and heart rate measurement system, external influences, and other factors that can affect heart rate and data processing.
- Neverest does not provide a warranty on third-party services or products (e.g., distribution system, low-voltage wiring, etc.).
- The warranty does not apply if the equipment is installed outside the country of purchase.
- Moving parts attached to the frame of the equipment (e.g. removable handles, seat and backrest sets, position adjusters, etc.) are not covered by the warranty.
This warranty does not apply to the following:
- Software updates.
- Software defects that, during installation and under normal use conditions, do not have a significant impact or adversely affect the functionality of the product.
- Consumable or cosmetic parts, including plastic or painted coatings, the appearance of which has been damaged by improper use, misuse, accident, improper maintenance or installation, design modifications not approved by Neverest, including the use of any replacement parts not manufactured by the original equipment manufacturer.
- External, structural or functional damage (including rust, corrosion and abnormal wear and tear) caused by failure to follow the maintenance procedures described in the accompanying product documentation.
- Repairs made to Neverest equipment without a serial number or with modified or damaged serial number markings.
- Cable routing systems.
- Self-delivery and delivery associated with the repair.
- Any installation costs incurred after the expiration of the installation warranty period.
Strength training machines (block, loadable)
During the warranty period the Seller shall provide repair or, if it is impossible, replacement of the equipment in case of manufacturing defects, provided that the Buyer complies with all conditions and rules of its transportation, storage, installation, adjustment and operation established by the Manufacturer.
The warranty period established by the Manufacturer for the new NEVEREST training equipment is 2 (two) years, for polyurethane belts, ropes, springs, bearings, guides the warranty period is 1 (one) year. The warranty period is calculated from the date of sale of the training equipment specified in the consignment note and warranty registration form.
Warranty repairs must be performed by a Neverest authorized service provider and/or Neverest authorized fitness center personnel.
If warranty repair at the place of its installation is impossible, the equipment must be sent to the Manufacturer for repair or replacement, with transportation and insurance costs borne by the Buyer and the cost of repair and spare parts borne by the Manufacturer.
The Buyer may send an application for warranty repair of the training equipment to the Seller or to the service center by regular mail, fax or e-mail, with mandatory attachment of copies of consignment note and warranty registration form of the faulty equipment, as well as the description of the fault, along with visual proof in the form of photographs or video-recordings of the faulty equipment, unit or mechanism, after which the representative of the Seller or the service center shall agree with the Buyer warranty repair term and place of performance. Any form of request for warranty repair is allowed, as long as it includes all the above information and the corresponding appendices.
If there are uncertainties and/or disputes between the Buyer and the Seller regarding the fact that the detected failure of the equipment is to be attributed to the category of warranty cases, as well as the impossibility to settle the dispute amicably, the latter shall be resolved in accordance with the procedure established by the current legislation of the Russian Federation.
The warranty is void if the event of:
- mechanical damage to the equipment, its components, assemblies and mechanisms caused by non-compliance with transportation, storage, installation, adjustment or operation conditions;
- the repair or modification of the equipment, replacement of original parts, made without a corresponding written consent of the Manufacturer, by a person who is not a representative of a corresponding service center and does not have the proper qualification;
- damage to the equipment as a result of force majeure circumstances, including natural, man-made and social emergencies, unlawful intentional and negligent actions of persons aimed at causing damage to the equipment.
- the Manufacturer’s guarantee obligations does not apply to anti-friction coatings (rubber and polyurethane handles and mats), soft elements (seats, backrests, armrests, rollers, etc.).
The Manufacturer’s guarantee obligations also do not cover:
- repairs to replace component parts, units and mechanisms of the equipment performed solely at the request of the Buyer, which were not caused by technical failure of the equipment and/or impossibility of its further safe operation.
- costs incurred by the Buyer during the period of malfunction of the equipment, including telephone calls, other means of communication used, rental of another equipment, transportation and insurance costs incurred in connection with the repair of the equipment, loss of time, loss of profit of the Buyer, etc.
- cost of works, components and materials required to perform periodic maintenance of the equipment in accordance with the established conditions of its operation.
- repairs, adjustment and replacement of component parts, units and mechanisms of the equipment, the need for which arose as a result of the Buyer's failure to comply with any of the conditions and rules of transportation, storage, installation, adjustment and operation of equipment established by the Manufacturer and specified above.
- natural (normal) noises and vibrations of the equipment, its units and mechanisms, natural wear, aging, discoloration, burnout, pollution, abrasions of painted or chromed surfaces.
In the event of disputes or disagreements regarding the compliance of the Seller or the Manufacturer of the equipment with its warranty obligations or the Buyer's compliance with the conditions and rules of transportation, storage, installation, adjustment and operation of the equipment established by the Manufacturer, not settled amicably, these disputes shall be resolved in accordance with the current legislation of the Russian Federation.
